Sun Jiwen, spokesperson of the Ministry of Commerce, said in response to this that the Appellate Body rejected the US appeal request and maintained the violation of the expert group's practice on the identification of public institutions, the specificity of land subsidies, and the initiation of countervailing investigations based on export restrictions. The ruling of the WTO rules further determined that the US standard for the use of external benchmarks in countervailing investigations against China did not comply with WTO rules. The Chinese side welcomes this.
Sun Jiwen said that the Appellate Body overturned the panel's ruling in response to the Chinese party's claim regarding the specificity and use of raw material subsidies. However, due to the fact that the expert group did not fully analyze this, the appellate body could not complete the legal analysis of whether the relevant US practices violated the WTO rules. The Chinese side expressed regret.
Sun Jiwen pointed out that this case involves my major trade interests and is an important victory for China to use the WTO rules, counter the US abuse of trade remedy measures, and actively protect its legitimate rights and interests. The WTO Appellate Body has clearly ruled that the United States’ practice in the measures involved is in violation of the WTO rules. The Chinese side hopes that the US side will face its long-term and systematic violation of the WTO rules and practices in the field of trade relief, urge the US to honor the WTO rulings in a timely manner, correct the wrong practices in violation of the WTO rules in a timely and comprehensive manner, and safeguard the authority and seriousness of the WTO rules.
